| Summary: | Resumo: A Constituição Portuguesa de 1976 – a sexta lei magna de Portugal e que representa o novo Constitucionalismo Democrático e Social trazido pela Revolução dos Cravos de 25 de Abril de 1974 – apresenta como um dos seus pilares fundamentais o sistema de direitos fundamentais, no qual são evidentes mudanças profundas não apenas numa conceção pluralista e aberta do catálogo dos direitos fundamentais positivado como também na efetividade da sua proteção jurídica contra a subversão que muitas vezes os poderes infraconstitucionais tentam operar no sentido de boicotar a sua realização prática. Abstract: The Portuguese Constitution of 1976 -the sixth magna law of Portugal and representing the new Social Democratic Constitutionalism brought by the Carnation Revolution of April 25, 1974 - presents as one of its fundamental pillars the fundamental rights system, in which profound changes are evident not only in a pluralistic and open design of the fundamental rights positivated catalog as well as on the effectiveness oftheir legal protection against subversion that often infraconstitutional powers try to operate to boycott their practical implementation.
